Thursday evening, Governor Andrew Cuomo posted his sixty-fourth Executive Order during this state of emergency. Executive Order 202.62, issued on September 9, 2020, issues a single directive that is designed to address matters related to the COVID-19 crisis. No Mask on Mass Transit? MTA now has a plan to enforce that.
- Executive Order 202.62 directs the Metropolitan Transportation Authority (MTA) to promulgate an enforcement plan to ensure compliance with all relevant Executive Orders and guidance applicable to its operations, including enforcement of face-covering requirements and ensuring availability of face-coverings for riders. The MTA, or any or all of its affiliates and subsidiaries, including New York City Transit Authority, the MTA Bus Company, the Long Island Rail Road, and the Metro-North Commuter Railroad may issue an emergency rule(s) to effectuate such plan. To that end, press reports indicate that a failure to wear a mask on NYC Subway or Bus, Metro-North or Long Island Railroad will result in a $50 dollar fine for the violator.
