Wednesday afternoon, Governor Cuomo’s office posted Executive Order 202.111, his one hundred and thirteenth Executive Order during the COVID-19 state of emergency, and his thirteenth since the law limiting Governor Cuomo’s authority to issue such orders was enacted.
Executive Order 202.111, dated June 15, 2021, discontinues the directive contained in Executive Order 202.107, as extended, insofar as it limited the number of people permitted to attend residential indoor gatherings and indoor social gatherings at events, arts, and entertainment venues, other than large-scale venues. As per Executive Order 202.111, effective June 15, 2021, there shall no longer be capacity limits on such gatherings. A copy of Executive Order 202.111 can be found here.
Critically, Governor Cuomo noted that large-scale indoor event venues (venues greater than 5,000), pre-K-12 schools, public transit, homeless shelters, correctional facilities, nursing homes and health care settings must still abide by existing COVID-19 health protocols per CDC guidelines. Governor Cuomo also recognized that the State’s health guidance and New York Forward industry specific guidelines—including social gathering limits, capacity restrictions, social distancing, cleaning and disinfection, health screening, and contact information for tracing—have become optional for retail, food services, offices, gyms and fitness centers, amusement and family entertainment, hair salons, barber shops and personal care services, among other commercial settings.
