Tuesday evening, Governor Cuomo’s office posted Executive Order 202.73, his seventy-sixth Executive Order during the COVID-19 state of emergency. Executive Order 202.73, dated November 9, 2020, contains a single, new directive designed to address matters related to the COVID-19 crisis. Executive Order 202.73 is effective from November 9, 2020 through December 9, 2020. A copy of Executive Order 202.73 can be found here.
NEW DIRECTIVE
Under Executive Order 202.73, the current modifications of law and regulation issued pursuant to Executive Order 202.30 as modified by 202.40, as extended, that require nursing homes to test staff, is further extended and modified to require that nursing homes located in red, orange, or yellow zones as designated pursuant to Executive Order 202.68 must test or make arrangement for the testing of all personnel, including all employees, contract staff, medical staff, operators and administrators, for COVID-19, as directed by the Health Commissioner.
