Friday evening, Governor Andrew Cuomo posted his sixty-first Executive Order during this state of emergency. Executive Order 202.59, issued on August 28, 2020, continues the suspensions and modifications of law, and any directives contained in Executive Orders 202.36 (here), 202.37 (here), 202.46 (here) and 202.47 (here), as extended and Executive Order 202.54 (here) for another thirty days through September 27, 2020. Executive Order 202.59, however, neither continues the directive permitting telephonic or virtual party nominating conventions, which has been superseded by Chapter 142 of the Laws of 2020, nor further extends the period for paying property taxes without interest or penalties pursuant to Real Property Tax Law Section 925-a. In addition, Executive Order 202.59 sets forth a directive which is designed to address matters related to the COVID-19 crisis. Now we need to think about the Flu!
- Summer coming to an end means a number of things – football (hopefully), pumpkin lattes and flu season. While Executive Order 202.59 does not tackle the crisis of early pumpkin latte proliferation, it does seek to address the pending flu season in light of the COVID-19 pandemic. Executive Order 202.59 provides that the State Health Commissioner shall develop by emergency regulations, comprehensive statewide protocols for the timely testing and reporting of all COVID-19 and Influenza cases to continue to ensure, as flu season approaches, the state has the most accurate data to evaluate the number of positive cases and to best ensure timely contact tracing efforts are implemented in all regions. Some regulations are expected to be issued early this week.
